Passenger Dies After Falling When Bus Brakes Suddenly... Bus Driver Gets Suspended Sentence
A bus driver who caused a passenger standing inside the bus to fall and die after braking suddenly received a suspended sentence of imprisonment without labor on appeal.
On November 1, the 3-3 Panel of the Jeonju District Court’s Criminal Division, presided over by Judge Jeong Se-jin, said it had dismissed the appeal filed by the defendant, identified as A, 61, who was indicted on a charge of causing death in violation of the Act on Special Cases Concerning the Settlement of Traffic Accidents. The panel upheld the original sentence of 10 months in prison without labor, suspended for two years.
A, a city bus driver, was indicted on charges of suddenly braking at a bus stop in Wansan-gu, Jeonju, North Jeolla Province, at 9:21 p.m. on April 18, 2024, causing passenger B, 69, to fall. B had stood up to get off at the stop when they lost their balance and fell. B was hospitalized and received treatment for injuries sustained in the accident, but died of respiratory failure on June 16 of the same year, about two months later.
Investigators found that A had been driving at 67 km/h on a road with a speed limit of 50 km/h before pressing the brake pedal. The appellate panel said, "As a driver of a city bus, the defendant was required to observe the speed limit and avoid sudden deceleration to ensure passenger safety. Given the degree to which the defendant breached this duty of care and the resulting consequences, the offense is by no means minor."

The panel added, "Furthermore, the defendant has a record of receiving fines for violating the Act on Special Cases Concerning the Settlement of Traffic Accidents in 1999 and 2008. The lower court appears to have determined the sentence after taking into account these circumstances, as well as the fact that the victim's surviving family members, who reached a settlement with the defendant, did not want the defendant punished." It cited these reasons for dismissing the appeal.
