"Apple to Pay 8 Trillion Won Plus Interest"... How Will Litigation Risks Affect Its Stock? [Click e-Stock]
A $5.7 Billion Damages Verdict, Plus Interest and Additional Claims
"Short-Term Noise, Limited Impact on Fundamentals"
After a patent infringement damages verdict, Apple has encountered a new complication: a claim for additional damages and interest. However, securities analysts say the impact on its stock price will be limited and short-lived.
According to Daishin Securities on the 21st, researcher Jo Jaewoon said the previous day, "This is an individual litigation risk unrelated to core fundamentals such as operating profit or revenue guidance," adding that "the impact on the stock price will be limited and short-lived."
Interest of up to 7% a year... Patent battle bill swells like a snowball
In September, a federal jury in California ordered Apple to pay $5.7 billion (approximately 8 trillion won) in damages in a patent infringement lawsuit filed by Taction Technology over haptic technology. It is the largest patent infringement damages award on record.

View original imageThe jury found that Apple's haptic technology, used in products since the iPhone 8 series under the name "Taptic Engine," infringed two of Taction's patents without authorization. The Taptic Engine generates subtle vibrations when users operate devices such as iPhones and Apple Watches, giving them tactile feedback, such as when they press a button or receive a notification.
Taction has also filed a claim for additional damages with the court, arguing that the original verdict covered only iPhone and Apple Watch sales from 2021 through the end of March this year. Taction requested damages for sales over the subsequent six months, as well as prejudgment interest at California's statutory rate of 7% a year and post-judgment interest. Interest alone could add at least several hundred million dollars. Apple has categorically denied any wrongdoing, said it plans to appeal, and filed a motion asking the court to overturn the verdict.
Researcher Jo noted that this case follows a pattern similar to one earlier in October this year, when Apple was ordered to pay $184.2 million in prejudgment interest on top of a $634 million damages verdict in a patent dispute with medical device maker Masimo. He said that interest is increasingly being added after the principal damages award in patent litigation, and that a similar outcome could occur in this case.
Quarterly net income tops $30 billion... "Apple has the capacity to absorb even 8 trillion won"
However, researcher Jo said, "$5.7 billion itself is manageable in light of Apple's quarterly net income." According to data compiled by financial information provider LSEG, Apple's projected net income for fiscal 2026 is $130.42 billion, with quarterly net income alone exceeding $30 billion. Its annual free cash flow (FCF) is also forecast to reach $142.87 billion.
Risk factors for Apple are shifting away from cost pressures, including its existing supply chain and tariffs, toward external litigation risks. Alongside a trade secrets lawsuit against OpenAI, the additional claim in this patent case has made legal disputes a factor weighing on investors.

The key issues are the court's decisions on Apple's motion to overturn the verdict, its appeal, and the method for calculating interest. Researcher Jo added, "If interest and damages for additional sales accumulate, uncertainty about provisions and the timing of cash outflows will persist. It could take years for the appeal to be resolved. This will not affect the income statement immediately, but it will remain a contingent liability until it is finally settled."
