Conditional Ruling Requires North Port Transfer Center to Halt Construction and Pay Compensation... BPA: "We Will Take Follow-Up Measures"
Busan District Court issues ruling on injunction application to suspend construction
Imposes obligations, including halting construction until a building alteration permit is obtained
Contract may be terminated in case of breach; securing the project's public role is key
The operator of the transfer center project in the Busan North Port Redevelopment District must suspend construction until it obtains a building alteration permit. It must also pay compensation for delays to the development.
Attention is focused on the future of the transfer center project after a court set these conditions for fulfilling its obligations in connection with an injunction application filed by the Busan Port Authority (BPA) over the operator's breach of contract.
The Busan Port Authority, led by President Song Sang-geun, announced on October 18 that it would continue to monitor whether the operator, P.Q. Construction, fulfills its contractual obligations and complies with relevant laws and regulations, following a decision by the Busan District Court on October 2.
Earlier, on June 16, the BPA notified P.Q. Construction that it was terminating the land sale contract, citing multiple breaches, including violations of the district unit plan. When the operator continued construction without agreeing to the termination, the BPA applied to the court for an injunction to suspend construction on June 26.
Under the court's decision, P.Q. Construction must eliminate level differences of 3 meters or more and suspend construction until it obtains a lawful building alteration permit. It must also pay compensation for development delays and submit a performance guarantee insurance certificate for demolition. Completing the rooftop plaza at the transfer center and obtaining approval for its use by the stipulated deadline are also contractual obligations.
The decision also includes a provision allowing the BPA to terminate the contract if even one of these obligations is not fulfilled. It is also reported to require the operator to state its position on demands to strengthen the transfer center's public role, including expanding transfer facilities.
The BPA viewed positively the operator's acknowledgment of the contractual breaches and commitment to take corrective action. However, procedures remain to verify whether the contractual obligations are actually fulfilled following the court's decision.
Concerns have been raised about public interest issues surrounding the North Port transfer center, including potential infringements on views and pedestrian access, as well as the need to expand transfer facilities. The BPA expects the decision to address these concerns and help put the project back on track.
