Man in His 60s Gets Lengthy Sentence Again on Appeal for Sexually Assaulting and Exploiting Young Niece for Years
Waiver of personal information disclosure over concerns the victim could be identified
"The crimes are serious, the defendant bears substantial responsibility, and the conduct warrants strong condemnation"
A man in his 60s who sexually assaulted and molested his young niece over several years and even produced sexually exploitative material was sentenced to a lengthy prison term again in his second trial. However, the appeals court waived the order to disclose and notify the public of his personal information, citing concerns that the victim could be identified.
According to Yonhap News Agency on October 14, the First Criminal Division of the Gwangju High Court's Jeju Branch, presided over by Judge Song O-seop, overturned the original ruling in the appeal of a man in his 60s identified as A, who was indicted on charges including violating the Act on Special Cases Concerning the Punishment of Sexual Crimes (rape of a minor under 13). The court maintained the eight-year prison sentence imposed at the first trial but waived the order to disclose and notify the public of his personal information.
A is accused of sexually assaulting and molesting his niece several times between 2023 and 2025, when she was under 13, and using a mobile phone to produce sexually exploitative material.
The appeals court ruled, "The defendant repeatedly committed these crimes by exploiting the victim's young age and their family relationship, which left her unable to offer any meaningful resistance. The crimes are serious, the defendant bears substantial responsibility, and the conduct warrants strong condemnation." It added, "We do not consider the sentence imposed by the lower court to be too harsh or too lenient." Accordingly, the court rejected both the defendant's and the prosecutor's arguments that the sentence was unfair.

However, the court explained that it waived the order to disclose and notify the public of the defendant's personal information because "the victim could be identified if the information were disclosed or made public, given their family relationship, potentially resulting in secondary victimization."
