BNJ was medically unable to conceive and give birth due to being born without a uterus. As a result, the couple entered into a non-profit surrogacy agreement with DZ and her spouse.
In April of last year, DZ underwent in vitro fertilization (IVF), having an embryo created from BNJ's egg and DRJ's sperm transferred to her uterus. However, about two weeks later, an unexpected finding appeared during an ultrasound scan. There were not just one, but two fetuses in her womb. Initially, it might have appeared that a single embryo had split, resulting in twins, but subsequent genetic testing revealed a completely different scenario.
The baby girl was the biological child of the intended parents, BNJ and DRJ. However, the baby boy was naturally conceived by DZ and her husband, FZ. Around the same period as the embryo transfer, DZ and her husband also conceived naturally, leading to two fetuses with no genetic relationship growing simultaneously in one womb. Both children were delivered by cesarean section on the same day in November last year. After the birth, there was no conflict between the two sets of parents regarding biological parentage. The baby girl has been raised by the intended parents, while DZ and her husband have raised the baby boy.
Australia's Courts Face Their First "Two-Family Twins" Case
Instead, it was the law that became the central issue. Article 24 of the Queensland Surrogacy Act restricts the issuance of a separate parentage order for just one child when multiple children are born from a single pregnancy. The law defines "birth siblings" as "a brother or sister born as a result of the same pregnancy." In other words, if a surrogate gives birth to twins, the law intends to prevent legal parenthood being split—one child going to the intended parents, while the other remains with the surrogate.

Although they grew together in the same uterus and were born on the same day, the baby girl originated from the transferred embryo under the surrogacy agreement, while the baby boy was conceived naturally by DZ and her husband. Judge Jodie Woodridge of the Queensland Children's Court ultimately recognized the unique aspects of this case.
The court determined that while the two children could be categorized as "gestational twins," as they shared the pregnancy and birth process, they do not fall under the surrogacy act's definition of "birth siblings." Consequently, the court allowed a parentage order transferring legal parenthood of the baby girl to BNJ and DRJ.
Pregnant, Then Pregnant Again? An Exceptionally Rare "Superfetation"
To understand how this event was possible, it is necessary to distinguish it from ordinary twins. Typically, dizygotic twins are created when two eggs released during a single ovulation cycle are fertilized separately. In contrast, the phenomenon where new ovulation, fertilization, and implantation occur after a pregnancy has already begun is known medically as "superfetation."
However, in the Australian case, the exact timing of natural conception relative to the embryo transfer has not been made public, making it difficult to definitively diagnose this as a case of superfetation. Generally, once pregnancy begins, hormonal changes inhibit ovulation, and the cervix and endometrium also change in ways that make additional fertilization and implantation nearly impossible, which makes such occurrences extremely rare. The Cleveland Clinic in the United States also notes that cases of superfetation confirmed in humans are exceedingly few. A significant number of reported cases are related to assisted reproduction techniques such as IVF.
Similar incidents have previously occurred in the United States as well. For example, in 2016, Jessica Allen in California became a surrogate for a Chinese couple and had their embryo transferred to her uterus. About six weeks into the pregnancy, a second fetus was discovered on ultrasound, and medical staff and the family initially believed they were identical twins formed from a split embryo. Allen delivered both babies by cesarean section in December of that year.

However, after birth, the two babies were found to look markedly different, prompting DNA testing. The result showed that one baby was the biological child of the Chinese couple, while the other was identified as Allen’s and her husband Wardell Jasper's biological son. Unlike the Australian case, the legal parentage in that instance was already processed in favor of the intended parents, making the situation even more complex. The Allens had to hire a legal representative to reclaim their son, and they were only reunited with him about two months after his birth, in February of the following year.
