A man in his 40s was sentenced to two years and six months in prison in the first trial for illegally filming by secretly installing a hidden camera in a staff-only restroom at a daycare center where his wife serves as director.
On June 18, the 11th Criminal Division of Suwon District Court (Presiding Judge Ji Seon-gyeong) sentenced Mr. A, who was arrested and indicted on charges including violation of the Act on Special Cases Concerning the Punishment of Sexual Crimes (filming using cameras, etc.). In addition to the prison sentence, the court ordered Mr. A to complete 40 hours of a sexual violence treatment program and imposed a seven-year employment restriction at institutions related to children and adolescents.
Previously, Mr. A was arrested and indicted on charges of illegally filming 12 staff members, including female teachers, by installing a small camera in a staff restroom on the first floor of a daycare center in Yongin, Gyeonggi Province, from early August to December 9 of last year. The daycare center in question is operated by Mr. A's wife, and Mr. A was found to have worked together as a driver.
During the investigation, evidence of destruction of evidence also came to light. Despite teachers discovering the camera in the restroom and requesting police intervention, Mr. A delayed reporting to the police for several days and instead attempted to erase the evidence by commissioning a private company for forensic work. Subsequently, he allegedly disposed of the SD card containing evidence by flushing it down the toilet, fled to Donghae, Gangwon Province, and threw the camera used in the crime into the sea. In light of these actions, prosecutors sought a three-year prison term for Mr. A.

The court stated, "A large number of victims—12 in total—were affected by this crime. The victims, who trusted the defendant as a colleague in their workplace at the daycare center, suffered harm over several months and experienced significant humiliation and psychological trauma." Regarding the grounds for sentencing, the court explained, "After the crime was discovered, the defendant obstructed the victims from reporting the incident, destroyed evidence, and repeatedly gave false statements during the investigation, showing a poor attitude."
