Government to Prepare Subordinate Statutes for AI Data Center Special Act... Detailing Permits and Special Provisions
The Ministry of Science and ICT announced on June 18 that it had formed a research group to prepare subordinate statutes for the “Special Act on the Promotion of the Artificial Intelligence (AI) Data Center Industry” (AIDC Special Act), which was promulgated on June 9, and held a kickoff meeting.
The AIDC Special Act stipulates special provisions such as: ▲ introducing a one-stop permit processing system and a timeout system through the Ministry of Science and ICT (as a unified window); ▲ exempting AI data centers built or expanded below a certain scale in non-capital regions, or existing data centers converted into AI data centers, from power grid impact assessments; ▲ relaxing installation standards for certain facilities (elevators, parking lots, artwork, etc.) that have been subject to the same requirements as general buildings.
In addition, the Act includes provisions supporting the overall AI data center industry, such as the definition of AI data centers, fact-finding surveys, workforce development, support for overseas expansion, and cooperation with local communities.
The Ministry of Science and ICT will operate the research group, composed of AI data center and legal experts, to draft the subordinate statutes. In particular, the ministry plans to gather opinions from private-sector experts and stakeholders, especially on the definition of AI data centers and regulatory exceptions, and to prepare effective statutes that reflect the characteristics of the AI data center industry.

Choi Dongwon, Director-General for AI Infrastructure Policy at the Ministry of Science and ICT, said, “The AIDC Special Act was established with the goal of supporting the rapid construction of AIDCs by the private sector and attracting investment to strengthen Korea’s AI infrastructure competitiveness,” adding, “We will do our utmost to quickly prepare the subordinate statutes of the AIDC Special Act through close communication with relevant ministries and industry stakeholders.”
