Kim Mi Ae Proposes 'Rally Transparency Enhancement Act'... "Banning False Representation and Inducement with Money or Goods"
Recently, as controversies have continued over the use of false representation or the offering of money and goods to induce participation in rallies and demonstrations, a new bill has been proposed to strengthen the requirements for clearly identifying rally organizers.
On April 9, Kim Mia, a member of the People Power Party (representing Haeundae-eul, Busan), sponsored an amendment to the “Act on Assembly and Demonstration,” aimed at strengthening the identification and representation of rally organizers and prohibiting inducement of participation through the provision of money or goods.
While the current law guarantees the freedom of assembly as a constitutional principle, there have been ongoing concerns that the legitimacy of certain rallies is undermined due to false representation or unclear organizer information, which can result in conflicts among local residents and a decline in social trust.
In particular, there has been an issue with the lack of clear legal grounds to regulate situations where false information is included in rally notifications or where promotional materials do not provide identifiable information about the organizer. This has made it difficult to effectively prevent deceptive practices.
This amendment seeks to address these issues by requiring organizers to clearly provide their address and information regarding community representation when submitting a rally notification, and by allowing police authorities to request supporting documents if false information is suspected. It also introduces penalty provisions such as imposing fines for failing to fulfill the obligation to provide organizer information or for submitting false information.

Assemblywoman Kim stated, “Freedom of assembly is a fundamental right guaranteed by the Constitution; however, actions such as false representation or offering money and goods can distort democratic decision-making.” She added, “While respecting the freedom of assembly, it is necessary to strengthen transparency and accountability to ensure that legitimate assemblies are protected.”
