Court Upholds Ruling to Cancel KCC Legal Sanction
In the context of the 22nd general election for National Assembly members in 2024, a court ruling ordering the Korea Communications Commission (KCC, now the Korea Media Communications Commission) to cancel a legal sanction imposed on the CBS radio program "Park Jae-hong's One Shot One Kill" was upheld on appeal.
According to the legal community on the 14th, the Administrative Division 11-1 of the Seoul High Court (Presiding Judges Choi Suhwan, Yoon Jonggu, and Kim Woosu) recently ruled in favor of the plaintiff, as in the first trial, in a lawsuit filed by CBS seeking the cancellation of the sanction imposed by the KCC.
The court stated, "The grounds for the defendant's appeal are not significantly different from the arguments made at first instance, and even after re-examining the additional evidence together with the evidence submitted in the first trial, the findings of fact and judgment of the lower court are justified."
Previously, in April 2024, the KCC, following a resolution by the Election Broadcasting Deliberation Committee for the 22nd general election (EBDC), imposed a legal sanction in the form of disciplinary action against those responsible for the CBS program "Park Jae-hong's One Shot One Kill." It cited remarks made by the cast during the January 17, 2024 broadcast as the grounds for the sanction. At the time, the guests said, in substance, that there was a prevailing atmosphere of silence within the People Power Party regarding the "Kim Keon-hee risk," and that in a particular constituency for the general election, "because it is a stronghold of the Democratic Party, there is not even anyone from the People Power Party applying for nomination."

In June 2024, CBS filed an administrative lawsuit seeking to have the sanction canceled. The first-instance court rejected the KCC's stated grounds for the sanction and ruled in favor of CBS, holding that the broadcast in question was not an election broadcast subject to review by the EBDC.
