Samsung Display Puts End to 3-Year 'OLED Technology Dispute' with China's BOE in Victory

Samsung Display has effectively concluded its nearly three-year OLED (organic light-emitting diode) technology dispute with China's BOE, emerging as the de facto final victor.
According to industry sources on November 19, Samsung Display recently reached a settlement with BOE regarding several disputes over patent infringement and trade secret misappropriation that had been ongoing in the United States, China, and other jurisdictions, and subsequently withdrew its lawsuits. This was also confirmed by the United States International Trade Commission (ITC). The ITC, which was originally scheduled to announce its final decision on the trade secret misappropriation dispute on the 17th (local time), instead issued a notice on the 18th stating that it would terminate the litigation between BOE and Samsung Display.
Previously, in December 2022, Samsung Display filed a patent infringement lawsuit with the ITC against BOE and several U.S. component wholesalers. In October of the following year, it filed an additional suit against BOE for trade secret misappropriation. In July of this year, a preliminary ruling in the trade secret misappropriation case resulted in a Limited Exclusion Order (LEO) that would prohibit BOE's OLED panels from being imported into the United States for 14 years and 8 months, leading many to view the case as a win for Samsung Display.

Separately from these lawsuits, Samsung Display was also engaged in patent negotiations with BOE. With both parties recently reaching an agreement through these negotiations, the lawsuits have now concluded. By mutual agreement, the specific details of the settlement have not been disclosed to the public. However, industry sources indicate that BOE agreed to pay patent royalties to Samsung Display as part of the final settlement.
