Passage of the National Sports Promotion Act Amendment: "Strengthening Athlete Human Rights Protection and Publicizing Sports Toto"
Establishment of Objection System and Granting Authority to Differentiate Disciplinary Levels
The Ministry of Culture, Sports and Tourism announced on the 31st that the amendment to the National Sports Promotion Act has passed the plenary session of the National Assembly.
With the passage of this amendment, a system for filing objections to the investigation results of the Sports Ethics Center will be newly introduced. Until now, victims or reporters could not raise objections to the dismissal or rejection decisions of the Sports Ethics Center, but from now on, they will be guaranteed the right to file objections within 30 days from the date of notification of the decision.
Going forward, the Sports Ethics Center will have the authority to request disciplinary actions distinguishing between severe and minor penalties against athletes involved in human rights violations or sports corruption. Minor penalties include reprimands and salary reductions, while severe penalties include suspension of qualifications for up to 10 years, competition suspension, suspension, demotion, dismissal, removal, and expulsion.
If a sports organization fails to comply despite the Sports Ethics Center’s requests for disciplinary action or system improvements, the Center will be able to demand supplementary or remeasures. This procedure will be codified, which is expected to resolve doubts about its effectiveness. If the sports organization refuses to comply with the remeasures request, the Ministry of Culture, Sports and Tourism, related central government agencies, and local governments will be granted the authority to restrict financial support to the sports organization within a period of up to two years.
Additionally, the Sports Ethics Center will be able to directly request disciplinary actions from sports organizations without going through the Ministry of Culture, Sports and Tourism, which is expected to shorten the administrative process time.
The Korea Sports Promotion Foundation will implement the Sports Toto issuance business through a separate subsidiary starting July 1, 2025, and plans to strengthen the legal basis of the business by adding "sports industry promotion" as a statutory task. Furthermore, among the sports industry sectors, loan support targets for equipment and service industries, which have relatively less loan support compared to facility industries, will be significantly expanded.
The sports industry loan budget will also increase by 84.4 billion KRW from 163.7 billion KRW in 2024 to 248.1 billion KRW in 2025, supporting the immediate realization of effects following the legal amendment.
