Elementary School Bully "Transfer Punishment Excessive" Lawsuit... Court Rules "Discipline Justified"
[Asia Economy Reporter Seoyoung Kwon] An elementary school student who was transferred for assaulting a classmate filed a lawsuit against the school but lost the case.
Today (the 16th), the Ulsan District Court Administrative Division 1 (Presiding Judge Jae-woo Jeong) dismissed the request to cancel the transfer disciplinary action filed by the student who committed school violence. The court ruled that the transfer was appropriate, noting the student's insufficient attitude of remorse.
In 2019, student A kicked and verbally abused student B, who was attending the same school, and was disciplined with a transfer by the school. While student A admitted and expressed remorse for the verbal abuse, they denied the physical assault. They also filed a lawsuit against the school, claiming that the transfer, the harshest disciplinary action, was an abuse of the school's discretion.
However, the court did not accept student A's claims. Prior to this incident, student A had already been warned by the school for assaulting student B, yet assaulted B again. As a result, student B received psychiatric treatment and demanded an apology from student A, but student A maintained that student B was lying.

The court stated the reasons for dismissal: "Despite other students' testimonies proving student A's physical violence, student A's level of remorse is minimal and weak," and "the transfer serves to inform student A of the seriousness of school violence and prevent recurrence."
