Deepfake Videos, Support Provided for Deletion of Youth and Child Sexual Exploitation Material
Deletion Requests Possible Through Agents
Mandatory Notification to Minister of Gender Equality for Sexual Violence in Public Institutions
Up to 3 Years Imprisonment or 30 Million Won Fine for Disadvantageous Personnel Actions Against Sexual Violence Reporters
[Asia Economy Reporter Hyunju Lee] The scope of support for the deletion of illegal filming materials will be expanded to include fake videos (deepfakes) and child and adolescent sexual exploitation materials. When a sexual violence incident occurs in a public institution, it must be reported to investigative agencies and notified to the Ministry of Gender Equality and Family.
The Ministry of Gender Equality and Family announced on the 10th that the partial amendment to the "Act on the Prevention of Sexual Violence and Protection of Victims (Sexual Violence Prevention Act)" passed the National Assembly plenary session on the 9th.
From now on, victims and their families, as well as representatives, can request deletion support from the Digital Sexual Crime Victim Support Center for damages caused by the distribution of illegal filming materials. In addition, legal grounds have been established to support the deletion of not only materials filmed using cameras but also fake videos created using image synthesis technology such as deepfakes, and child and adolescent sexual exploitation materials.
When a sexual violence incident occurs in a public institution, it must be reported to investigative agencies and notified to the Minister of Gender Equality and Family. The Minister may conduct on-site inspections and, based on the results, request corrections or improvements. Employers who take unfair personnel actions against reporters of sexual violence incidents due to their reporting may face imprisonment of up to three years or a fine of up to 30 million won.
Minister of Gender Equality and Family Jeong-ok Lee said, "We will continue to actively respond to digital sexual crimes through ongoing institutional improvements and make policy efforts to eradicate sexual violence in daily life, such as workplaces and schools."
