Wemade Wins Arbitration in Singapore for 'Mir 2' (Comprehensive)
Arbitral Tribunal "License Agreement Terminated as of September 28, 2017"
Won Against Chinese Game Company 'Jiuling' Last Month
"Utilizing All Legal Means to Protect IP and Strengthen Rights"
[Asia Economy Reporter Jin-gyu Lee] Wemade announced on the 25th that it won the arbitration lawsuit held in Singapore against Chinese game companies regarding 'Legend of Mir 2.'
In May 2017, Wemade filed an arbitration lawsuit with the Singapore International Arbitration Centre (SIAC) against Actoz Soft, China’s Shanda Games, and Lansha Information Technology to terminate and invalidate the Legend of Mir 2 license contract and claim damages. At that time, Wemade claimed that "Actoz Soft and Shanda Games had unilaterally extended the Legend of Mir 2 license contract without prior consultation with our company."
The Singapore arbitration tribunal stated in its ruling that "the license contract between Wemade, Actoz Soft, and Lansha Information Technology was terminated as of September 28, 2017, and the license contract has lost its effect thereafter." It also ordered that "Actoz Soft and Shanda Games must compensate Wemade for damages." The amount of damages will be determined through a separate procedure.
This ruling confirmed that Shanda Games and others do not have the rights to the Legend of Mir 2 license. Their use of the Legend of Mir 2 license constitutes an infringement of the Legend of Mir 2 IP. Wemade requested, "Anyone or any company that has signed or received a sublicense contract related to Legend of Mir 2, or is aware of such sublicenses, should report to Wemade."

Meanwhile, Wemade has been winning consecutive lawsuits against Chinese game companies, including a recent arbitration victory against the Chinese game company Jiuling at the Korean Commercial Arbitration Board for breach of license contract. At that time, the Korean Commercial Arbitration Board ruled that "Jiuling must pay Wemade 294.6 billion KRW in damages including interest." Wemade CEO Jang Hyun-guk said, "It has become clearer that the Mir-related IP belongs to Wemade," and added, "In addition to damages, we plan to use all legal means, including claims for damages, to protect and strengthen our IP rights."
